This Refund and Cancellation Policy outlines the rights, obligations, and procedures applicable to Bitily system users regarding the cancellation of subscribed plans and the request for refunds. This policy complies with current consumer protection laws, data protection regulations, and best commercial practices.
1. Cancellation Right – With Access Until the End of the Current Billing Period
Users may cancel their active plan at any time through the control panel by navigating to: User → Subscription → Cancel Subscription.
The cancellation will take effect at the end of the current billing cycle, with access to all contracted features maintained until that date.
During this period, the user’s data and functionalities will remain available, under the responsibility and protection of Bitily.
At the end of the billing cycle, the paid subscription features will be automatically deactivated, and any usage exceeding the plan limits may be restricted or deleted.
2. Right of Withdrawal with Refund – 7-Day Period
Users may exercise their right of withdrawal with a full refund within 7 (seven) calendar days from the plan subscription date.
To secure a refund within the legal timeframe, the following steps are required:
-
Access the Dashboard → Subscription → “Cancel Plan”;
-
Complete the cancellation form and confirm the request using the access password;
-
Submit a request via the control panel chat, email (contato@bitily.com.br), or the Contact Page form, stating the cancellation and refund request.
If all conditions are met within the specified period, the refund will be issued in full, and the cancellation will be processed immediately.
3. Effects of Cancellation and Data Deletion
After cancellation with refund, all features, benefits, and limits associated with the subscribed plan will be immediately suspended.
Important: Data stored under the canceled plan’s limits may be deleted, blocked, or paused—especially if they exceed the limits of the Free plan.
The user will be automatically migrated to the Free Plan, available to all users with an active account. Data exceeding the Free Plan limits may be removed without prior notice.
If the user wishes to revoke the refund cancellation request, they must contact the support team within 2 (two) hours of submitting the request. However, reversal is not guaranteed.
Once the cancellation and refund are confirmed, the process is irreversible, and no data or previous configurations can be restored.
The only way to resume a paid plan is by subscribing again, without any guarantee of data restoration.
4. Cancellation and Refund of Annual or Lifetime Plans
Users who subscribe to annual or lifetime plans are entitled to a full refund if they request cancellation within the first 7 (seven) days of the subscription date.
If this period is exceeded, a partial refund may be requested, provided that the request is made within 3 (three) months of the subscription date. In such cases, the amount corresponding to the used period will be deducted.
After the 3-month period, refunds will no longer be available, regardless of the reason.
Note: The 3-month period does not apply to upgrades with proportional refunds from previous plans.
5. Partial Refund for Plan Upgrades
When upgrading to a higher plan, users may request a proportional refund of the previous plan, provided that:
-
The new plan has been fully paid;
-
The request for proportional refund of the previous plan is formally submitted;
-
Days already used from the previous plan are non-refundable.
6. Refund Method
All refunds will be processed using the same payment method used at the time of subscription, subject to the timelines and procedures of the financial intermediary, over which Bitily has no control or responsibility.
Important: If technical or operational restrictions prevent refunding via the original payment method, an alternative bank account in the name of the original payer (individual or entity) will be required.
A refund receipt will be issued and sent to the user’s registered email, serving as formal proof of the transaction.
7. Data Backup
Before requesting cancellation with refund, users must perform a complete backup of all data, files, records, and content stored on the platform.
Export features are available in the control panel and should be used prior to submission.
Users are solely responsible for backing up their data and ensuring its integrity. Bitily is not liable for data loss resulting from cancellation.
8. Disclaimer of Liability
Bitily and its partners are not liable for data loss, technical limitations, or any damages arising from the refund-based cancellation requested by the user.
Access to features and benefits depends on having an active and valid plan. Cancellation with refund or payment default will result in the automatic loss of paid features, leaving only the Free Plan limits available.
9. Support and Inquiries
For questions or requests, users may contact the support team through the following channels:
-
Chat in the control panel;
-
Email: contato@bitily.com.br;
-
Contact form on the Contact Page.
This policy may be updated at any time to ensure legal compliance and continuous improvement of services.
Users are responsible for staying informed of any changes.
